Welcome to Home Buyer Readiness Score, LLC ("Home Buyer Readiness Score," "we," "us," or "our"). We are excited to provide tools, insights, and connections to help you better understand your mortgage readiness and prepare for homeownership.

When you use Home Buyer Readiness Score, you enter into a legal agreement. While we have written these Terms as clearly as possible, they include important legal protections. To help, we have included short Summaries under each section. These are not part of the agreement but are provided to make things easier to understand.

1. Our Services

1.1 Definition of Services.

"Services" means all products, features, content, and tools operated by Home Buyer Readiness Score, including:

  • Mortgage readiness assessments.
  • Personalized action plans.
  • AI-powered Smart Mortgage Coach insights.
  • Dashboards, reports, and professional tools.
  • Connections with real estate agents, builders, and other professionals.
  • Mobile applications, websites, and related platforms.

1.2 Informational Purpose.

Our Services are designed to provide information and guidance. We do not originate loans, extend credit, or act as a lender, broker, or financial institution.

Summary: We provide tools, insights, and educational resources to help you understand mortgage readiness. We are not a lender or financial institution.

2. Eligibility and Accounts

2.1 Eligibility.

You must be at least 18 years old and capable of forming a binding contract to use the Services.

2.2 Account Creation.

To access certain features, you may be required to register an account. By registering, you agree to provide accurate information and keep it updated.

2.3 Account Security.

You are responsible for all activities under your account. Do not share your login credentials. Notify us immediately of unauthorized use.

2.4 Termination.

We may suspend or terminate accounts for violations, false data, or unlawful use.

Summary: You need to be an adult, keep your account secure, and use accurate information. We can suspend accounts for misuse.

3. Limitations and Restrictions on Use

3.1 Informational Use.

Any assessments, estimates, or outputs are for informational purposes only. They do not guarantee loan approval.

3.2 No Professional Advice.

We are not attorneys, CPAs, tax advisors, financial planners, or investment advisors. The Services do not replace personalized professional advice.

3.3 AI Limitations.

Our Smart Mortgage Coach uses artificial intelligence. While designed to be helpful, AI may generate inaccurate or incomplete outputs. Always verify independently.

3.4 Territorial Restrictions.

Our Services are intended for use within the United States.

3.5 Compliance with Law.

You must comply with all applicable laws when using the Services.

Summary: Our Services are educational. We are not professional advisors, and AI outputs may not always be accurate. The Service is U.S.-only and must be used lawfully.

4. Borrower-Specific Terms

4.1 Voluntary Data Submission.

Borrowers provide personal and financial data voluntarily, including income, credit, and employment information.

4.2 No Guarantee of Loan Approval.

Scores and recommendations do not guarantee mortgage approval, funding, or terms. Final decisions rest with lenders.

4.3 Independent Verification.

Borrowers should consult licensed mortgage professionals before making financial decisions.

5. Agent, Builder, and Professional Terms

5.1 Data Responsibilities.

Agents, builders, and professionals are solely responsible for handling client data in compliance with privacy and consumer protection laws.

5.2 Ethical Use.

Professionals may not misuse or sell client data, and must not misrepresent readiness scores as guarantees.

5.3 Professional Liability.

You are fully responsible for your own interactions and advice to clients.

Summary: If you are an agent or builder, you must handle client data responsibly and cannot promise outcomes based on our scores.

6. Ownership and Intellectual Property

6.1 Our Content.

All content, software, logos, and intellectual property are owned by Home Buyer Readiness Score or its licensors.

6.2 License.

We grant you a limited, non-exclusive, revocable license to use the Services as intended. No copying, modification, or reverse-engineering is permitted.

Summary: The platform and content belong to us. You can use them for their intended purpose but not copy or misuse them.

7. User Content and Feedback

7.1 License to User Content.

If you submit data, feedback, or content, you grant us a non-exclusive, royalty-free license to use it solely to provide, improve, and promote the Service.

7.2 Responsibility.

You warrant that your submissions do not infringe on third-party rights.

8. Privacy and Security

8.1 Privacy Policy.

Our Privacy Policy explains how we collect and handle data. By using the Services, you consent to data practices described there.

8.2 Security.

We use industry-standard security measures, but transmissions cannot be guaranteed secure.

8.3 Children's Data.

We do not knowingly collect information from children under 13. If discovered, such data will be deleted.

9. Disclaimers

The Services are provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy, and non-infringement.

10. Limitation of Liability

To the maximum extent allowed under Texas law, our total liability is limited to the greater of:

  • The fees paid to us in the past 12 months, or
  • $100.

We are not liable for indirect, incidental, special, consequential, or punitive damages.

11. Indemnification

You agree to indemnify and hold us harmless from claims, losses, or expenses arising from:

  • Your use of the Service.
  • Your violation of these Terms.

12. Dispute Resolution and Arbitration

12.1 Governing Law.

These Terms are governed by the laws of the State of Texas, excluding conflicts of law principles.

12.2 Arbitration.

All disputes will be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, in Dallas County, Texas.

12.3 No Class Actions.

You waive the right to participate in class actions. Claims must be brought individually.

Before starting arbitration, you must send written notice to:

Summary: Disputes are resolved by arbitration in Dallas. No class actions. Notices must be mailed to our Texas address.

13. Termination and Deactivation

You may deactivate your account at any time. We may terminate your account for violations. Provisions such as liability limits, disclaimers, and arbitration survive termination.

Summary: You can close your account anytime. Some legal terms remain in effect even after termination.

14. Miscellaneous

  • Entire Agreement: These Terms, plus our Privacy Policy, are the full agreement.
  • Changes: We may update these Terms; continued use means acceptance.
  • Waiver: Our failure to enforce rights is not a waiver.
  • Assignment: You may not assign your rights; we may assign ours.
  • Severability: If part of these Terms is invalid, the rest remain effective.
  • Force Majeure: We are not liable for events outside our control such as disasters, pandemics, or outages.
